We reserve the right to change these terms and conditions, our returns policy and privacy policy at any time. You should check these pages regularly to take notice of any changes we may have made to the Terms of Service. 

 It is your responsibility to read the terms and conditions, our returns policy, and privacy policy on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions and other policies on the above pages   

Introduction

This website is operated by Anika’s Gift Shop Trading as Anika’s Gift Shop /ABAI Ltd (referred to as “This Is It/we/our/us”) a limited company registered in England & Wales under 11634368 whose registered address is Suite 108, 264 Lavender Hill, London, SW11 1LJ.   

As a user of this website (referred to as “you/your”) you acknowledge that any use of this website including any transactions you make (“use/using”) is subject to our terms and conditions below and our returns policy, privacy policy and cookie policy.   

Ordering from us

All contracts of sale made by Anikas Gift Shop will be treated as an offer by you to purchase the goods subject to these terms and conditions. 

You can order products online via www.personalisedgiftsshop.co.uk. When you place an order for a product you are offering to buy it for the price stated. We will send you an order acknowledgement by email.  

Acceptance of your order and the completion of the contract between you and us will take place on dispatch to you of the products ordered and we will send you a dispatch email, unless we have notified you that we do not accept your order or you have cancelled it (please refer to our Returns Policy). Only those goods listed in the confirmation email sent at the time of dispatch will be included in the contract formed. 

We may refuse to accept an order if; 

  • We do not receive your payment 
  • There has been a pricing, discount offer or products description error 
  • The ordered products are out of stock or discontinued 
  • Personalized products contain content which may cause annoyance or inconvenience such as indecent, offensive, racist, pornographic, etc. 
  • If the product is to be delivered outside of the United Kingdom.    

Pricing

All prices on our website are inclusive of VAT but do not include delivery charges. Delivery charges will be displayed and payable as indicated at the time of placing your order. 

Goods, Pricing and Availability

We make all reasonable efforts to ensure that all descriptions and graphical representations of Goods available from Us correspond to the actual Goods.  Please note, however, the following: 

  • Images of Goods are for illustrative purposes only.  There may be slight variations in color between the image of a product and the actual product sold due to differences in computer displays and lighting conditions. 
  • Images and/or descriptions of packaging are for illustrative purposes only, the actual packaging of Goods may vary. 
  • Please note that the above clause does not exclude Our responsibility for mistakes due to negligence on Our part and refers only to minor variations of the correct Goods, not to differentiate Goods altogether. Please refer to our Returns policy if you receive incorrect Goods (i.e. Goods that are not as described). 
  • We cannot guarantee that Goods will always be available. Stock indications are provided on Our Site, however such indications may be inaccurate, if, for example, stock is lost or damaged in our warehouse. 

Delivery

Most orders are delivered within 7 working days. Dates are given in good faith but are not the subject of any warranty or condition. No liability will attach to us if delivery periods or dates are not met. Please feel free to contact us if you have any queries regarding this matter. Please refer to our delivery info for more information 

We will deliver the goods ordered by you to the address that you give us during your order process. Goods returned described as undeliverable or not called for, will be subject to a redelivery charge. We reserve the right to wait up to 10 working days from the date of dispatch before replacing an undelivered item.   

Some postal addresses in Northern Ireland, some offshore islands and some remote areas of Great Britain may not be covered by our normal delivery services and so we may have to contact you to advise you of extra postal charges. 
 
The majority of our products are dispatched   If you have not received your items, please check with your local sorting office. 
 
In the event that we reproduce an item for you and subsequently the original is returned as undelivered by Royal Mail, we reserve the right to charge an administrative fee up to 100% of the trade price of the reproduced product. 

Next Day Delivery

Next day delivery is available Monday to Friday, except bank holidays for products where stated. 
(a) From Monday to Friday, orders must be placed by the specified cut off period to ensure delivery the next day. 
(b) Orders placed on a Friday before the specified last order time will be delivered on the following Monday. 
(c) Orders placed on a Saturday/Sunday will be delivered on the following Tuesday. 
(d) Unfortunately we cannot deliver on a bank holiday. In this instance please expect your delivery on the next working day. 
(e) Our carriers will normally deliver your parcel between 9am and 5pm but certain carriers may deliver later; unfortunately we cannot give you a more specific delivery time than this. 
(f) A signature may be required on receipt. 
(g) If you are not around to accept your parcel, the carrier may leave it with a neighbour, or in a safe place, if they think it is safe to do so. A calling card will be posted through your door to let you know this has been done. 
(h) If the parcel can’t be left in a safe place or with a neighbour, the carrier will take it back to the local depot, and leave you a card telling you how you can pick it up. 
 
Next Day Delivery to Northern Ireland, Overseas UK addresses and Northern Scotland will take up to 48 hours. Any orders exported to the USA and Canada are at your own risk, Anika’s Gift Shop will not be held liable for these orders. 
 
Please note: we will not be held liable for any late deliveries if delays occur by causes beyond our reasonable control including, without limitation:- 

  • Fire  
  • Severe weather conditions;  
  • industrial dispute;   
  • strike or labour disputes 
     

Order Cancellations

If you wish to cancel your order you can notify us during office hours by email to Info@anikasgiftshop.com before the goods have been placed into production. 

We may not be able to make changes or cancel the order if the order has been passed to our production team to personalize or already dispatched. 

If you no longer want your order after it has already been personalized (whether it has left us or not) we won’t be able to offer a credit or a refund. 

We reserve the right to cancel your order at any time and issue a full refund. 

Please Note: In order to provide a fast service, some products are immediately sent for production. Please ensure to check your order during the order process and the confirmation email carefully as we cannot refund or cancel your order for personalized products which have been misspelt or you have had a change of heart. 

The provisions of this clause do not affect your statutory rights. 

Returns and Exchange

For cancellations of orders, amendments to orders or changes or corrections to personalization please contact our customer service at info@anikasgiftshop.co.uk with following 

  • Order number 
  • Name 
  • Address 
  • Details of the product 
  • Reason for return 
  • Whether you require a refund or replacement 

We will then advise on the next course of action.

Incorrect item received.

If the item received is not what was originally ordered or is faulty, please contact our customer service at info@anikasgiftshop.com with following:

  • Name 
  • Address 
  • Details of the product 
  • Reason for return 
  • Whether you require a refund or replacement 

We will then advise on how to proceed with the return. Refunds will not be issued if the fault is as a result of misuse. 

Non-Personalized

For items with no personalization – Goods can be returned for refund within 30 daysWe reserve the right to charge you for the collection of the item from you, unless the item is faulty

The content of this website is subject to change without notice. While we intend that all information on the website should be as accurate and up to date as possible, wdo not provide any guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found on this website. 

To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is excluded.

Liability

To the full extent permitted by law, our liability for breach of an implied warranty or condition is limited to the supply of the goods and/or services again or payment of the costs of having those goods and/or services supplied again.  

We accept no liability for any loss whatsoever including consequential loss suffered by you arising from product/s we have supplied. 

 We also take all due care in ensuring that our website is free of any virus, worm, Trojan horse and/or malware, however, we are not responsible for any damage to your computer system which arises in connection with your use of our website or any linked website. 

By accessing our website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website or products. 

Governing Law and Jurisdiction

These terms and conditions are to be governed by and construed in accordance with the laws of England and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in England and you agree to submit to the jurisdiction of those Courts. 

Miscellaneous

If any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect. 

Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website. 

Force Majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control. 

Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
